Content and Services Agreement and Enforcement (CSAE)

Lately (the "App") is a peer-to-peer image-sharing platform created by Bild Technologies, LLC ("Company," "we," "our," or "us"). By using Lately, you (the "User" or "you") agree to abide by the terms of this Content and Services Agreement and Enforcement (the "Agreement"), including but not limited to the following guidelines governing acceptable content and behavior within the App. Failure to comply with these rules may result in account suspension, termination, or legal action.
1. Purpose of the App
Lately allows users to share images, engage in visual content creation, and collaborate with others. This service aims to foster creativity, communication, and community in a positive and respectful manner, while prioritizing the safety and well-being of all users, especially minors.
2. Prohibited Content
Users must not upload, share, or distribute any content through the App that:
Violates the law: Content that violates any local, state, or federal law, regulation, or policy, including but not limited to pornography, hate speech, harassment, or content related to violence or illegal activity.
Infringes intellectual property rights: Content that infringes on the intellectual property rights (copyright, trademark, etc.) of others.
Promotes harm or discrimination: Content that promotes discrimination, racism, sexism, homophobia, or any form of hate speech.
Contains harmful material: Content that is misleading, defamatory, threatening, abusive, or violent.
Compromises privacy or security: Content that invades the privacy of others, including sharing personal information without consent (doxxing), or that contains malware, viruses, or other malicious software.
Child Sexual Abuse or Exploitation: Lately has a zero-tolerance policy regarding child sexual abuse, exploitation, and any form of child pornography. Content that exploits or harms children in any way is strictly prohibited. Users are prohibited from sharing, uploading, or distributing any content that sexually exploits or abuses minors, whether real or simulated. This includes the creation, sharing, or solicitation of any explicit material involving children, whether the child is a subject of the image or video or is being exploited in any other manner. Such actions are criminal offenses and will be reported to the appropriate authorities immediately.
3. Child Safety and Reporting
We are deeply committed to protecting the safety and well-being of children. If you encounter any content that involves child sexual abuse, exploitation, or other child safety concerns, you must report it immediately. Lately collaborates with law enforcement and child protection organizations to help prevent and respond to incidents of child abuse and exploitation.
Users must:
Immediately report suspected abuse: If you suspect any content violates our child safety standards, report it directly through the App’s reporting tool or contact our support team at support@livelately.com. All reports will be investigated promptly.
Cooperate with investigations: Users who engage in illegal activities, including those involving children, may face legal action. The Company reserves the right to fully cooperate with law enforcement authorities, including providing any user information required for criminal investigations.
4. Account Conduct and User Behavior
Users agree to:
Act respectfully: Treat all members of the Lately community with respect. Abusive, threatening, or discriminatory behavior will not be tolerated.
Be truthful: Avoid misleading other users or providing false information through the App.
Respect content ownership: Do not upload images that you do not own or have explicit permission to share.
Refrain from spamming: Refrain from sending excessive unsolicited messages or promotional material to other users.
Comply with child safety regulations: Users are prohibited from engaging in any behavior that could lead to the abuse, exploitation, or harm of children. This includes taking, sharing, or distributing inappropriate content, engaging in grooming behaviors, or using the platform to communicate with minors in a way that violates our community guidelines.
5. Enforcement and Violations
The Company has the right to take action in response to any violation of this Agreement, including but not limited to:
Suspension or termination of user accounts: If a user is found to be in violation of the App’s policies or engages in conduct deemed harmful to the community or service, their account may be suspended or terminated.
Content removal: The Company reserves the right to remove any content that violates this Agreement or is deemed inappropriate at its sole discretion, including content related to child sexual abuse or exploitation.
Legal action: In cases of severe violations or illegal activity, particularly involving child sexual abuse or exploitation, the Company will take legal action and report the behavior to the relevant authorities, including law enforcement.
6. Liability and Disclaimers
The Company is not responsible for the content uploaded or shared by users. While we monitor and enforce the rules outlined in this Agreement, the Company does not guarantee the accuracy, reliability, or legality of the content shared through the App. Users are solely responsible for the content they share and the interactions they have with others.
7. Changes to the CSAE
The Company reserves the right to update or modify this Agreement at any time. Any changes will be posted on the App or on the website, and the updated Agreement will be effective as of the date of posting. Continued use of the App following any changes constitutes acceptance of the revised terms.
8. Governing Law
This Agreement is governed by the laws of the state of Pennsylvania, USA, without regard to its conflict of law principles.
